Texas’ No-fault divorce. The most common grounds for a court approving a divorce in Texas is called “insupportability.” Specifically, the marriage has become “insupportable because of discord or conflict of personalities that destroys the legitimate ends of the marital relationship and prevents any reasonable expectation of reconciliation.” Texas Family Code, Section 6.001.
The person seeking the divorce on grounds of insupportability, usually Petitioner or both parties, must prove three elements to be awarded the divorce and they are fact questions. However, because they are subjective, all that is required is the testimony of one of the parties of the three elements. Per one Texas case, the Petitioner must prove: (1) that the marriage has become insupportable because of a discord or conflict; (2) that discord or conflict destroys the legitimate ends of the marriage, and (3) there is no reasonable expectation of reconciliation.
But God says that what he has joined together, let not man separate, and that nothing is impossible with God, and that we are to be ambassadors of reconciliation. Therefore, I believe that it should be difficult if not impossible for a Christian to say that there is no reasonable expectation of reconciliation. Nevertheless, Christians in the midst of a broken marriage don’t find it hard in their desperation to escape the problem to say that there is no hope.
